Abstract

The article deals with the emergence of the first codification of labor law in the Czech legal environment, i.e. Act No. 65/1965 Sb., the Labor Code. The synthesis of archival and other research by colleagues (especially L. Vojáček, B. Havelková and V. Steinová) is supplemented by an interview with
a direct witness to these preparatory works and co-author of the text of this code, Associate Professor Jarmila Pavlátová. The key complication in all three stages of the preparation of the Code had always been economic conditions, twice thwarting its adoption. The third time it passed – probably because due to simultaneous recodifications of other branches of law it was necessary for the economy to fill the gap in the legal regulation created by the disappearance of the classical contract for work from the legal system. The chosen means, agreements on work performed outside the employment relationship, has survived in Czech labor law to this day.
